Caplan Legal Consulting Professional Corporation (“Caplan Legal,” “I,” “me”) operates caplanlegal.ca (the “Site”). This policy explains what personal information I collect, why, and what you can do about it. I handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), applicable Ontario law, and my professional obligations as a lawyer licensed by the Law Society of Ontario.

Information I collect

If you contact me through the Site’s form or by email, I collect the information you choose to provide, such as your name, email address, organization and message.

The Site does not use analytics or advertising tools. My hosting provider may log standard technical information, including IP addresses, for security and operational purposes.

I do not knowingly collect information from anyone under 18.

How I use it

I use personal information to respond to your inquiry, to check for conflicts of interest, to discuss and provide legal services, and to send communications you have asked to receive. I do not use it for automated decision-making or profiling.

Consent

By submitting information through the Site, you consent to its use for these purposes. You can withdraw consent at any time by emailing elana@caplanlegal.ca, although that may mean I can no longer respond to your inquiry or act for you.

Sharing

I do not sell, rent or trade personal information. I share it only with service providers that help me operate the practice, such as website hosting, form delivery and email providers. These providers may store or process information outside Canada, including in the United States, where it may be subject to local laws, including lawful access by courts and government authorities.

I may also disclose information where required by law, court order or a regulator, including the Law Society of Ontario, or to establish or defend a legal claim.

Cookies

The Site does not use tracking or advertising cookies. My hosting provider may set essential cookies needed for security and basic operation.

Retention

I keep inquiry correspondence that does not lead to an engagement for as long as needed to respond and to maintain conflict-checking records. Client information is kept as required by my professional and record-keeping obligations.

Security

I use reasonable administrative and technical safeguards, including access controls and reputable service providers. No method of transmission over the internet is completely secure.

Your rights

You may ask to access the personal information I hold about you, correct it, or withdraw consent to its use. Email elana@caplanlegal.ca and I will respond within 30 days. Some information may need to be kept to meet my professional obligations. If you are not satisfied with my response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Visitors in the EEA and UK

If you are in the European Economic Area or the United Kingdom, you have additional rights under the GDPR, including to access, correct, delete, restrict or object to the processing of your personal data, and to data portability. My legal basis for processing is your consent and my legitimate interest in responding to inquiries and operating the practice. You may complain to your local supervisory authority.

Email

I send email only to people who have contacted me, are clients, or have asked to hear from me, consistent with Canada’s Anti-Spam Legislation (CASL).

Changes

I may update this policy. The effective date above shows the latest version.
